TESTMU CONFERENCE TERMS AND CONDITIONS
LambdaTest, Inc., doing business as TestMu AI ("Company," "TestMu AI," "we," or "us"), is committed to contributing to the community and highly values the need to create opportunities for professionals to connect, share information, build knowledge, and learn from the community. To foster this objective, Company conducts events on a periodic basis to encourage the open exchange of ideas and to support professional development and personal growth.
Company always strives to implement robust measures to ensure that its events and gatherings are inclusive, respectful, productive, and harassment-free.
This document lays down the terms and conditions regarding any conference organized by Company and the rights and obligations of any participant in such conference, including any speaker, sponsor, exhibitor, or other attendee (collectively, "Attendee" or "you").
BY CLICKING "I ACCEPT," OR BY REGISTERING FOR ANY EVENT, CONFERENCE, OR WEBINAR CONDUCTED OR MANAGED BY COMPANY, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND, AS A CONDITION TO YOUR PARTICIPATION, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, INCLUDING COMPANY'S PRIVACY POLICY. IF YOU ARE NOT ELIGIBLE, OR DO NOT AGREE TO THESE TERMS, THEN YOU DO NOT HAVE OUR PERMISSION TO PARTICIPATE. YOUR REGISTRATION AND/OR ACTUAL PARTICIPATION IN ANY CONFERENCE OR EVENT CONSTITUTES AN AGREEMENT BY YOU TO BE BOUND BY THESE TERMS.
These terms and conditions constitute the entire agreement between Company and Attendee regarding Company conferences and supersede any prior or separate understandings and instruments between the parties, provided however, that Company may notify Attendees of additional rules and regulations relating to a specific conference or contest. Company reserves the right at all times to change, amend, add, or remove any of these terms without prior notice. If one or more of the conditions outlined in these Terms & Conditions should be or become invalid, the remaining conditions will continue to be valid and apply.
1. REGISTRATION
- Registering online will be regarded as an acceptance of these terms and conditions.
- Company reserves the right to cancel bookings or registrations without notice. In case of any cancellation, Company shall not be liable for any loss or damage suffered by Attendee.
- If you opt in to receive information about upcoming TestMu Conference editions, you consent to Company sharing updates about TestMu Conference and related community initiatives with you by email or telephone. You may unsubscribe at any time by following the instructions in the communications received. Company handles your information as described in the Privacy Policy.
2. PRIVACY
- Company shall process the personal information supplied in the process of registration in accordance with Company's Privacy Policy (https://www.testmuai.com/legal/privacy/), which is incorporated herein by reference.
- Attendee agrees to be contacted by email, direct mail, or telephone by Company for the purpose of receiving information about the conference, or about opportunities that Company believes may be of interest to the Attendee.
- Company may share this information with its partners, vendors, and event sponsors.
3. EVENT PLATFORM AND ACCESS
- The conference is delivered through one or more third-party virtual event platforms. By registering, you acknowledge that your participation is also subject to the terms and privacy practices of that platform, and that Company does not control and is not responsible for the availability, performance, or data practices of any third-party platform.
- Attendee is responsible for their own internet connectivity, hardware, and software required to access the conference. Company does not warrant uninterrupted or error-free access.
- Registration is personal to the Attendee. Access credentials and joining links must not be shared, resold, or transferred.
4. CANCELLATION
If an Attendee wishes to cancel their registration, they must inform Company in advance or unsubscribe through the link provided in the registration notification email. Attendees may also contact Company at support@testmuai.com.
If the program is cancelled by Company, Company shall inform the Attendee via email. Company, event hosts, or any other individual associated with the event will not be responsible for any liability for such cancellation.
Company reserves the right to change the conference program, including speakers, sessions, session times, and format, at any time and without notice.
5. CONTENT, PHOTOS & FILMING
Any content or materials to be used by Attendee in the conference in any way, including but not limited to materials or content presented during any lecture or presentation (collectively, "Content"), must be pre-approved by Company.
Attendee is and will remain the sole and exclusive owner of all right, title, and interest in and to all Content, including all intellectual property rights relating thereto, subject to the rights and permissions granted to Company below. Attendee warrants that the Content does not:
- infringe any third-party proprietary, intellectual property, industrial property, personal rights, or other rights, including without limitation copyright, trademark, patent, trade secret, or confidentiality obligation; or
- otherwise violate applicable laws and regulations.
Attendee hereby grants Company and its affiliates a perpetual, paid-up, worldwide, royalty-free license to use, reproduce, electronically distribute, transmit, have transmitted, transfer, perform, display, store, archive, and make derivative works of the Content for its internal and external business purposes.
Photos, screengrabs, and audio/video recordings (collectively, "Recordings") will be taken by Company at the conference for promotional purposes. Attendee hereby consents to be filmed and recorded by Company. Company shall exclusively own such Recordings and shall be free to use them without restriction for any lawful purpose. You expressly and irrevocably assign all right, title, and interest in the Recordings to Company.
Company may, but is not obligated to, make session Recordings available to Attendees or to the public after the conference. Nothing in these terms obligates Company to record, retain, or publish any particular session.
6. CONTESTS, CHALLENGES AND PRIZES
Company may run contests, challenges, quizzes, hackathons, leaderboards, and similar activities in connection with the conference (each, a "Contest"). Participation in any Contest is subject to these terms and to any additional rules published for that specific Contest. Where the two conflict, the Contest-specific rules control.
Eligibility. Unless the Contest-specific rules state otherwise:
- You must be a registered Attendee of the conference for any entry to be considered.
- You must meet the general eligibility requirements in Section 7 below.
- Employees, contractors, and immediate family members of Company and of participating partners and sponsors are not eligible to win.
- Participation may be void where prohibited or restricted by applicable law.
Judging and decisions. All Contest decisions, including eligibility, scoring, judging criteria, interpretation of rules, and selection of winners, rest with Company in its sole discretion. Company's decisions are final and binding on all participants. Company is not obliged to enter into correspondence regarding individual results or scores.
Verification and disqualification. Company reserves the right to verify any entry and to disqualify any entrant who, in Company's sole judgment, submits a fraudulent, automated, duplicated, plagiarised, or otherwise non-genuine entry; manipulates the entry or scoring mechanism; uses multiple accounts; or breaches these terms or the Code of Conduct.
Changes to Contests. Company reserves the right to modify, suspend, extend, or cancel any Contest, in whole or in part, and to substitute any prize with one of comparable value, at any time and without notice.
Prizes. Prizes are awarded as stated in the Contest-specific rules and are non-transferable and non-exchangeable, with no cash alternative unless Company states otherwise. Winners may be required to provide identity, contact, tax, or payment information before a prize can be issued, and Company may withhold a prize where such information is not supplied within a reasonable period. Winners are solely responsible for any taxes, duties, or charges arising from receipt of a prize. Delivery timelines are estimates only, and Company is not liable for delays or losses in delivery by third parties.
Promotional credits and offers. Any product credits, trial access, vouchers, or similar offers made available to Attendees in connection with the conference are subject to the terms of the relevant product or offer, may be time-limited, and may be varied or withdrawn by Company at any time.
Contest submissions. For any Contest requiring a submission (including code, projects, or hackathon entries), Attendee retains ownership of their submission and grants Company the license set out in Section 5. Attendee warrants that the submission is their own original work, that they hold all necessary rights in it, and that it does not infringe the rights of any third party. Attendee is responsible for ensuring their submission does not disclose confidential information belonging to their employer or any third party.
Publicity. By accepting a prize, a winner agrees that Company may announce their name, employer, likeness, and submission in connection with the Contest, except where prohibited by law.
7. ELIGIBILITY, CODE OF CONDUCT AND GUIDING PRINCIPLES
Eligibility. You confirm that you are at least 18 years of age, or the age of majority in your jurisdiction of residence if higher, and that you possess the legal right and capacity to understand and agree to these terms and conditions.
Code of Conduct. To provide a conducive environment that fosters community and positive connections, Attendees are expected to comply with the following. Attendees shall:
- Treat all participants and other Attendees with respect and dignity.
- Follow all applicable rules and procedures of the event as may be communicated from time to time.
- Be mindful of their surroundings and of their fellow participants.
- Exercise consideration in their speech and actions.
- Maintain adequate decorum when posting content related to the event on social media.
- If a speaker, be mindful of the time consumed in their session and ensure there is no spillover into the subsequent scheduled session.
- Do not impose or market their organization or products on, or pressure, other Attendees to procure products. Giving an overview of the Attendee's organization and products is acceptable.
- Refrain from any kind of harassment, bullying, microaggressions, intimidation, or insinuations that are hurtful (for instance, demeaning or discriminatory language, personal insults, or sexist or racist language) or that interfere with any other Attendee's experience or participation.
- Refrain from unwelcome sexual attention, including sexualized comments or jokes, or inappropriate or sexually coloured comments.
- Do not disrupt speakers while they are presenting. Attendees shall ask questions and seek clarification during the designated Q&A periods.
- Do not include any sexually explicit or violent material in any presentation or Content, in informal settings, or on personal devices.
- Refrain from any other illegal activity or form of harassment not covered above.
Consequences of unacceptable behaviour. Breach of the above conditions or any other unacceptable behaviour will not be tolerated. Where an Attendee is asked by a Company volunteer to stop engaging in unacceptable behaviour, they are expected to comply immediately. If an Attendee breaches any of the above conditions, engages in unacceptable behaviour, or fails to comply with expected behaviour at any time during the event, Company may take any action it deems appropriate, including but not limited to removing the Attendee from the event without refund (if applicable), disqualifying them from any Contest, forfeiting any prize, and banning them from future events.
If Attendees witness or are subjected to unacceptable behaviour, or have any other concerns regarding the event, they are requested to contact Company immediately at support@testmuai.com.
8. WEBSITE & LINKS
The site where Attendees register online for any conference may include links to third-party websites. These links are provided for Attendees' convenience to provide further information. They do not signify that Company endorses the third-party website(s). Company has no responsibility for the content of any linked website.
9. TRADEMARK
Company and its affiliated companies reserve all rights to their Marks (Company's names, trademarks, service marks, and logos, including LambdaTest, TestMu AI, Testμ, TestMu Conference, KaneAI, and Kane CLI). The Marks are highly valued intellectual property, and Company will take the necessary steps to guard against dilution and against the use of third-party marks that are confusingly similar to the Marks or likely to be confused with the Marks.
10. INDEMNIFICATION
Attendee agrees to indemnify, defend, and hold harmless Company, its affiliated companies, and the respective officers, directors, employees, or agents of any such entities from and against all claims, liabilities, damages, losses, costs, expenses, and fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from (i) Attendee's (or anyone using Attendee's account) violation of these terms and conditions; and (ii) any injury suffered by any person or damage to property caused by or in consequence of any act or omission of the Attendee. Company reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by Attendee and, in such a case, Attendee agrees to cooperate with Company's defence of such claim. In no event may Attendee agree to any settlement affecting Company without Company's written consent.
11. DISCLAIMERS
All information, content, products, and services provided in connection with the conference by Company are provided "as is" and "with all faults" with no warranties of any kind. Company shall have no liability for anything said by any speaker, sponsor, or exhibitor at the conference. Company expressly disclaims, to the fullest extent permitted by law, all express, implied, statutory, or other warranties and representations, including without limitation warranties arising from a course of dealing, usage, or trade practice. Without limiting the generality of the foregoing, Company makes no warranty that the conference will meet Attendee's requirements.
Except as expressly provided hereunder, to the fullest extent permitted by law, in no event will Company be liable for any direct, indirect, special, consequential, incidental, punitive, or exemplary damages in connection with the participation by an Attendee in any conference or as a result of the services or information provided at the event, whether such damages are based on warranty, contract, tort, statute, or any other legal theory, and even if Company has been advised (or should have known) of the possibility of such damages.
12. GOVERNING LAW
These terms and conditions and any dispute arising between Company and Attendees shall be subject to the laws of the State of Delaware.
In the interest of resolving disputes between you and Company most expediently and cost-effectively, you and Company agree that every dispute arising in connection with these terms and conditions will be resolved by binding arbitration. This agreement to arbitrate disputes includes all claims arising out of or relating to any aspect of these terms and conditions, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of whether a claim arises during or after the termination of these Terms. YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND COMPANY ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.
